Lawyer seeks IGP Baharul’s removal over BDR massacre report

Md Abdus Samad, a Supreme Court lawyer, submitted the legal notice on Thursday, citing Articles 27, 31, 32, and 102 of the Constitution.

A Supreme Court lawyer has filed a public-interest petition seeking the removal of Bangladesh’s police chief, Baharul Alam, who is among the accused in the independent commission’s BDR massacre report.

The notice urges senior officials in the home, law, and public administration ministries to explain why he remains in office despite alleged politically motivated actions during his tenure in the Special Branch.

Md Abdus Samad, a Supreme Court lawyer, submitted the legal notice on Thursday, citing Articles 27, 31, 32, and 102 of the Constitution. He said the BDR probe commission’s report contains enough evidence to implicate Baharul Alam and called for his immediate removal.

The petition highlights Baharul Alam’s alleged role in following political orders from the previous Awami League government and acting against opposition figures during his Special Branch tenure.

The BDR massacre occurred on February 25–26, 2009, in Dhaka’s Pilkhana, killing 74 people, including 57 army officers led by then-BDR chief Major General Shakil Ahmed. Courts later sentenced 139 individuals to death, 185 to life imprisonment, and at least 228 others to various terms. The investigation and judicial process faced scrutiny and protest from victims’ families since the outset.

After over a decade of controversy and a student-led uprising in July 2024, the interim government formed a seven-member national independent commission on December 24, 2024. The commission submitted its report to Dr. Muhammad Yunus, chief adviser of the interim government, on November 30, 2025.

The report presented information against IGP Baharul. In particular, he has been accused of playing a role in implementing the political agenda of the then Awami League government and being active in taking action against the opposition while serving in the Special Branch (SB) of the police.

The report presented findings against IGP Baharul Alam, accusing him of alleged involvement in politically motivated operations during his tenure in the Special Branch. The commission’s findings form the basis of Samad’s petition, which calls for immediate action under constitutional and legal obligations to maintain accountability at the highest levels of law enforcement.
